Soni Brendle prevails in North Carolina Court of Appeals alimony case

The North Carolina Court of Appeals the last set of 2020 Opinions on December 31st. Soni Brendle was fortunate to end the year with another win.  Ketan Soni and Andrew Brendle were retained after the alimony trial to pursue our client's appeal.   The full opinion can be found by clicking here.

The case involves a contested alimony claim that went to trial in Mecklenburg County.  Soni Brendle was able to convince the Court of Appeals that the trial court made an error in its ruling by refusing to consider any "bad acts" by the wife in this matter. The trial court also improperly back-dated alimony to prior to the parties' separation and also failed to provide adequate factual basis for the duration of alimony, thus vacating the judgment in part.

Judge David Strickland joins Soni Brendle as Partner

Soni Brendle, PLLC is honored to welcome David H. Strickland to the firm beginning January 2021.  After serving as a Mecklenburg County Judge for eight years, David is uniquely situated to provide private arbitration services to other North Carolina attorneys as the court system continues to be bogged down by COVID-19.  When he is not serving as an arbitrator, David will also handle construction law, commercial and civil litigation, and family law cases for the firm.

 

He graduated from Wake Forest University in Winston-Salem, N.C. and obtained his law degree at Campbell University in 2002.

New Zoom Features to Improve Communication: Clients, Mediation, Arbitration (and more!)

Ketan Soni has been using Zoom and other remote technology to deliver divorce and estate planning legal representation, arbitration and mediation services since before the start of COVID. Click here to read about Ketan’s latest post on the North Carolina Bar Association’s website about some of the latest Zoom features and how they positively impact your experience. This information applies whether you are a lawyer, mediator, arbitrator, or any person who uses Zoom in their business and personal activities!

There is a relation between how Zoom is used and how effective lawyers can be in communicating with their clients or parties in a lawsuit.  What may seem like minor adjustments, like moving a video screen, can actually create better rapport and understanding between everyone involved. Think about a phone conversation versus an in-person meeting. You can obtain more visual cues that help you understand what the other person is really trying to say. That same concept is true when having conversations with family law and estate planning clients, litigants in the court system, and parties to an arbitration.

Ketan Soni appointed to North Carolina Dispute Resolution Commission

Soni Brendle is proud to announce that Ketan Soni has been appointed to the NCDRC Commission for a 3-year term!

The North Carolina Dispute Resolution Commission was established in October of 1995, pursuant to N.C. Gen. Stat. § 7A-38.2. The Commission is charged primarily with certifying and regulating private mediators who serve the courts of this State. The Commission also recommends policy, rules, and rule revisions relating to dispute resolution in North Carolina’s courts; provides support to court-based mediation programs; certifies mediation training programs; serves as a clearinghouse for information about court-based mediation programs; assists other State agencies interested in or providing dispute resolution services to their constituencies and publishes a newsletter.

Ketan has been mediating since 2011 in Superior and District Courts which primarily involve family law matters.  He uses the 20 years of divorce litigation and his experience resolving cases to assist spouses who wish to avoid the court system.  The use of mediation as an alternative to litigation has become increasingly popular as the costs of divorce skyrocket across the state.  This process provides couples with an option to have a greater say in the ultimate result of their own case.

As the governing body for court-ordered mediation in North Carolina, Ketan will have an opportunity to shape the future of mediation and dispute resolution with other colleagues across the state.  Congratulations!

Keeping track of the kids:  Child Custody tips in Charlotte and North Carolina

Going through a divorce is difficult for any family.  Parents go through an emotional and financial rollercoaster as they try to figure out what lives will look like after everything is either settled or litigated in front of a judge.  I find that most divorcing spouses haven’t planned for the turmoil in their lives.  One of the most chaotic parts of divorce that spouses manage poorly is what happens with the custody schedule for the kids.  On top of these challenges, add COVID-19 to the mix in 2020! As August is here and the new school year has already started, check out these tips to make your life and the lives of your children easier.

  • Ditch the paper calendar when communicating.

Paper is great when the only person you have to manage is yourself.  You have to coordinate children, schedules, virtual learning, pods for kids, and former spouses.  Instead of paper, use technology to save your life.

Here are some ways:

  • Free Option: Google calendar. You can make a separate sub-calendar with your gmail account. One calendar can be all your “personal” stuff that you don’t share. A second calendar can be a “custody” calendar that you share with the other parent, the parents of your child’s pad, (and the children themselves!).   These calendars are easily accessible from any smartphone, as well.

 These calendars also allow you to “share” without letting others add dates. For instance, you can share the calendar with grandparents, uncles and aunts who are there to help you out during these trying time. Those folks can see the calendar, but they can’t add content.

You can add reminders, events, documents, modifications of the schedule, and notes.  Here’s a tutorial from Google: http://support.google.com/calendar/?hl=en#topic=6076998

  • Paid Option: Our Family Wizard. A great option is Our Family Wizard (https://www.ourfamilywizard.com/) for $99 per parent.

These services will do what Google calendar does, and a ton more!  There are shared calendars, journals, expense logs, message boards, and information banks.  This app works on any smartphone.  For those families that never seem to escape the court system, you can also give access to attorneys or other professionals as you see fit.  An amazing feature is also the ToneMeter™, which tells you when message to the other parent need to be reworded!

  • Print it for yourself

If you can’t completely let go of the paper calendar, go ahead and print it when everything is finalized on the electronic calendar. It’s ok to print, even though you’re killing a tree.

  • Plan in Advance.

The kids are going back to school.  You go to ‘Back-to-School’ sales and plan what the kids need, right? Do the same with the annual schedule, even though COVID-19 has destroyed the ability to plan far in advance.

Figure out which parent is supposed to get each holiday, teacher workday, and vacation day from now until June 2021.  Then, send an email to the other parent asking to confirm. Don’t wait until the last minute.

  • Figure out your work schedule.

If you travel for work, now’s the perfect time to get your travel schedule, if available. Communicate this schedule to the other parent.  Even though your order says “10 days advance notice”, why would you wait that long?  Decrease the conflict in your life. Also tell the other parent your job’s new travel policy. Since everything has changed, some parents are still flying. Others are grounded indefinitely. If you want to remove unnecessary conflict in your life, communicate even though you may not want to!

  • Review your Order/Agreement

Take 30 minutes and review your court order or parenting agreement every single year. There may be something you forgot, or something that changes, or something critical that you’re missing.  It won’t hurt to revisit the document that is supposed to govern your children’s lives.

  • DO IT NOW

Life for kids gets crazy when they go back to school. Don’t wait until one month into school to implement these tips. If you wait, you will never do it. Give yourself a 7-day deadline to get these tasks done.
